CJEC: enhanced passenger rights
Passengers are generally entitled to compensation even if their connection has been canceled due to a strike by cabin crew. There are only exceptions in limited individual cases, according to a European Court of Justice ruling released on Wednesday. The complaint was lodged by a consumer who claimed 250 euros because his Salzburg-Berlin flight was canceled due to a strike (File C-613/20). Eurowings airline alleged that the shutdown was a so-called extraordinary circumstance and that the company had taken all reasonable steps to limit the effects of the strike. The highest European court, however, believes that it is foreseeable that if a parent company calls a strike, employees from other parts of the group will join the strike.
