BGH – stop on real estate scrap – economy

Even a completely dilapidated property will likely need to be renovated by the community of owners if it would otherwise be impossible to continue using it. The Federal Court of Justice (BGH) is heading towards this judgment in an Augsburg dispute. According to the law, the renovation obligation does not apply if a building is “destroyed at more than half of its value”. But that should only mean real destruction by fire or flooding, as presiding judge Christina Stresemann said in Karlsruhe – and no rot. The final decision is to be announced on October 15 (Az. V ZR 225/20)
