BGH – judgment on thermal insulation – economy

Anyone who retrospectively isolates their old building on the property line can use it to protrude a bit into the neighbor’s garden. This was decided on Friday by the Federal Court of Justice (BGH) on the basis of a neighborhood dispute in Cologne. However, new construction should be planned so that the thermal insulation remains within the limits of your own property. The BGH also clarified: in the interest of climate protection, countries can regulate subsequent thermal insulation with their own regulations (Az. V ZR 115/20). The energy renovation of buildings must lead to energy savings, which is in the general interest. In Cologne, neighbors had argued over the planned exterior insulation of an apartment building, located directly at the property line.
